1. Acceptance of terms
By downloading, installing, or using the Dubs app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of service
Dubs is a personal content-to-audio and note-taking application provided by Bradley Berkman, an individual based in the United States ("we," "us," "our"). The App may change, be updated, or have features added or removed at any time without notice.
3. Eligibility
The App is not directed at, and may not be used by, anyone under the age of 13. By using the App you represent that you meet this requirement.
4. Acceptable use
You agree not to use the App to:
- Violate any applicable law or regulation.
- Upload, transmit, or store content that infringes another party's intellectual property or other rights.
- Attempt to gain unauthorized access to the App's systems, credentials, or data belonging to another user.
- Interfere with or disrupt the App's operation or servers.
5. Your content
You retain ownership of any content you submit to the App (text, notes, recordings, images). By submitting content, you grant us a limited license to store, process, and transmit that content solely as necessary to provide the App's functionality to you. We do not claim ownership of your content and do not use it for any purpose other than operating the App on your behalf.
6. Intellectual property
The App, including its design, code, and branding, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
7. Third-party services
The App relies on third-party service providers to function (e.g., cloud hosting, storage, and content-processing services). Your use of the App is also subject to those providers' applicable terms where relevant. We are not responsible for the availability or performance of third-party services outside our control.
8. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP.
10. Termination
We may suspend or terminate your access to the App at any time, with or without cause. You may stop using the App at any time.
11. Changes to these terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
